1.Promotion Overview

The Intake Breathing Boarding Group Giveaway Game (“Promotion,” “Game”) is a limited-time event in which eligible participants may receive an Intake Breathing Starter Kit by joining one of four Boarding Groups. Groups 1–2 offer paid instant boarding. Groups 3–4 offer free entry and require maintaining a qualifying position on a dynamic leaderboard.

The Promotion runs from December 2, 2025 at 9:00 AM PST through December 5, 2025 at 11:59 PM PST, or until 2,500 total Starter Kits have been distributed, whichever occurs first.

NO PURCHASE NECESSARY to enter or win in Groups 3–4.

A purchase in Groups 1–2 does not increase chances of receiving anything beyond the guaranteed Starter Kit associated with paid instant boarding.

Void where prohibited.

2.Eligibility

The Promotion is open to:

  • Legal residents of the United States
  • Age 18 or older

The Promotion is void where restricted or prohibited by law.

Employees, contractors, and household members of Intake Breathing are not eligible.

3.Boarding Groups & Entry Methods

Participants may enter one of four Boarding Groups.

3.1 Groups 1 & 2 — Paid Instant Boarding (Guaranteed Spots)

Groups 1–2 provide immediate, guaranteed boarding upon payment.

Participants in Groups 1–2 will receive:

  • One new Intake Starter Kit (30 uses, Black Bands)
  • Approximate retail value (ARV): $59.99

Additional terms:

  • Paid instant boarding secures a spot immediately and permanently while inventory lasts.
  • Paid entry does not improve odds of receiving any additional benefits, prizes, or upgrades.
  • If payment is processed after inventory is depleted due to system error, a full refund will be issued.

Groups 1–2 are not a sweepstakes or chance-based contest. All paying participants receive the kit while supplies last.

3.2 Groups 3 & 4 — Free Entry with Dynamic Leaderboard (Skill-Based Contest)

Groups 3–4 are free to join and operate entirely on a skill-based, action-based leaderboard.

Leaderboard Rules

  • Participants may enter Groups 3 or 4 at no cost.
  • To receive a Starter Kit, participants must finish within the top 2,500 positions at the exact time the Promotion ends.
  • Standings may change frequently based on participant activity.
  • Participants may lose their position (“be kicked out”) if others earn more points.
  • Participants may re-enter or climb by completing in-game actions.

Leaderboard Actions

Actions that may impact leaderboard rank include (but are not limited to):

  • Referring friends (referral only counts if the friend signs up via the participant’s unique referral link)
  • Following Intake Breathing on Instagram
  • Completing additional actions listed within the Game dashboard
  • Returning frequently to track rank

The Game interface displays real-time scoring and rules.

Free Kit Details

Participants in Groups 3–4 who finish within the top 2,500 will receive:

  • One refurbished Intake Starter Kit (15 uses)
  • Sanitized, safety-tested, and fully functional
  • May show minor cosmetic wear
  • ARV: $29.99

Receipt of a free kit for Groups 3–4 is not guaranteed and depends entirely on final leaderboard position.

Tie-Breaking

If a tie occurs at or near the cutoff (position 2,500), the participant who reached the tied point total earliest will be ranked higher.

4.Starter Kit Distribution & Fulfillment

  • A total of 2,500 Starter Kits will be distributed across all Boarding Groups.
  • Group 1–2 participants receive guaranteed kits upon payment.
  • Group 3–4 participants must maintain rank within the top 2,500 by Promotion end.
  • Sponsor fulfills all kits after the Promotion ends.
  • Shipping times may vary based on order volume and carrier delays.
  • Sponsor may substitute items of equal or greater value if necessary.

Winners from Groups 3–4 may be required to confirm eligibility and provide valid shipping information within a stated timeframe.

5.Payments, Refunds & Transparency (California-Compliant)

  • Payments for Groups 1–2 are non-refundable once a spot is secured and a kit has been allocated.
  • If an allocation error occurs, the participant will receive a full refund.
  • Paid entry does not increase chances of receiving rewards beyond the guaranteed Starter Kit.
  • No purchase is required to enter Groups 3–4 or remain in the skill-based leaderboard competition.

This Promotion is designed to comply with all applicable California “no purchase required” laws and general U.S. promotional rules.

6.Odds of Receiving a Starter Kit

  • Groups 1 & 2: Guaranteed receipt of a kit while inventory lasts.
  • Groups 3 & 4: Odds depend on:
    • Number of participants
    • Timing of actions
    • Total points earned
    • Final ranking at Promotion end

Rankings may shift at any time; participants are encouraged to check back frequently.

7.Participant Responsibilities

Participants are responsible for:

  • Providing accurate contact and shipping information
  • Completing eligible actions correctly
  • Ensuring referrals sign up via their unique link
  • Monitoring leaderboard standing
  • Following any updates or rule changes posted within the Game interface

Sponsor is not responsible for:

  • Technical issues, connectivity problems, or downtime
  • Lost, delayed, or misdelivered shipments
  • Referral tracking failures caused by third-party platforms
  • Incorrect or incomplete addresses
  • Bot activity, fraudulent accounts, or manipulation attempts

Sponsor may disqualify any participant for suspected fraud, bot use, or rule violations.

8.Social Media & Platform Disclaimers

This Promotion is not sponsored, endorsed, administered by, or associated with Instagram, Meta, or any other third-party platform used during participation.

Participants agree to release Instagram/Meta from any liability related to this Promotion.

Participants who post referral links publicly should clearly disclose that they are participating in a contest and may receive a benefit if others sign up (FTC endorsement compliance).

9.General Conditions

Sponsor reserves the right to:

  • Modify, suspend, or terminate the Promotion if technical issues or fraud compromise fairness
  • Disqualify any participant violating rules
  • Enforce all terms in Sponsor’s sole judgment

If the Promotion cannot run as planned due to force majeure, Sponsor may issue alternative rewards of equal or greater value or close the Promotion early.

10.Governing Law

This Promotion is governed by the laws of the State of California, without regard to conflict-of-law principles.

All disputes will be resolved in the state or federal courts located in Santa Barbara County, California.

11.Privacy Notice

Information collected during this Promotion is used solely for:

  • Administering the Promotion
  • Verifying eligibility
  • Communication regarding the Promotion
  • Fulfillment and delivery of Starter Kits

Participant data will be handled according to the Intake Breathing Privacy Policy.

California residents retain all rights under the California Consumer Privacy Act (CCPA) and may submit data requests using the contact methods listed in the Privacy Policy.
